Terms of Service

1. Agreement to Terms

By accessing or using TrackCoach360 ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including coaches, assistant coaches, and any other authorized users.

2. Description of Service

TrackCoach360 is a web-based platform designed for track & field coaches. The Service provides tools for roster management, race result logging, VDOT score calculation, training pace generation, workout building, race predictions, and shareable athlete pages. The Service is accessible via web browsers on any device.

3. Account Registration and Security

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Be at least 18 years old or an authorized representative of your school or organization
  • Keep your login credentials confidential and not share your account with others
  • Notify us immediately of any unauthorized access to your account

You are responsible for all activity that occurs under your account.

4. Subscription Plans and Billing

TrackCoach360 offers a 14-day free trial that requires no credit card. After the trial, continued access requires a paid subscription. Subscription details, including pricing and plan features, are available on our pricing page.

  • Subscriptions are billed on a monthly or annual cycle, depending on the plan you choose
  • You may upgrade, downgrade, or cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • Refunds are not provided for partial billing periods

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Share your account credentials with unauthorized individuals
  • Attempt to access, scrape, or extract data from the Service through automated means
  • Upload harmful, offensive, or misleading content
  • Interfere with or disrupt the Service or its infrastructure
  • Use athlete data for purposes unrelated to coaching and athletic performance management

6. Athlete Data Responsibilities

As a coach using TrackCoach360, you are responsible for the athlete data you enter into the Service. You represent that:

  • You have appropriate authorization to enter and manage athlete information
  • If working with minor athletes, you have obtained necessary parental or institutional consent
  • You will use athlete data responsibly and in accordance with applicable laws, including FERPA if you are a school-based coach
  • You will not share athlete data outside the platform except as permitted by your institution's policies

7. Intellectual Property

TrackCoach360 and its original content, features, and functionality are owned by TrackCoach360 and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all data you enter into the Service. By using the Service, you grant us a limited license to process and display your data solely for the purpose of providing the Service to you.

8. Disclaimers

Training guidance, not medical advice. TrackCoach360 provides training paces, workout suggestions, and race predictions based on the VDOT methodology developed by Dr. Jack Daniels. These calculations are tools to assist coaching decisions and are not a substitute for professional medical advice, diagnosis, or treatment.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that calculated paces and predictions will be suitable for every athlete.

9. Limitation of Liability

To the fullest extent permitted by law, TrackCoach360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of or inability to use the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms or engage in conduct that we determine is harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days following termination to allow for data export, after which it will be deleted in accordance with our Privacy Policy.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
